Castro, Janet Bandu to be legally “declared dead” in July

Hip Life act, Theophilus Tagoe professionally known as Castro, and his female friend Janet Bandu, will be legally ‘declared dead’ in July 2021, after they disappeared on a Jet Ski on the Ada River, seven years ago.

They had gone on a vacation with footballer Asamoah Gyan when the incident happened near the estuary at Ada while jet skiing on the Volta river.

Their disappearance raised a lot of questions about whether they were dead or alive, after all, attempts to find their bodies proved futile.

Investigations revealed that when someone drowns in any water body, the dead body should be washed back to the banks after three days. But in the Castro and Janet incident, no bodies were found till date.

Some persons have alleged that they had seen Castro in Togo. Others say he has been hiding in Takoradi, while some believe he is dead.

Efforts to retrieve their bodies by a number of fetish priests and religious leaders have all proved futile.

By law in Ghana, an individual can be declared dead by a court after seven years of disappearance.
The Evidence Act of 1975, Section 33, states that a person can only be declared legally dead after seven years by a court, where the person in question has not been seen or heard from in seven years despite diligent and persistent efforts to find him.

After July 6, 2021, Castro and Janet will be considered as departed souls. They are no longer part of the living by laws of Ghana.

Asamoah Gyan who has been interrogated severally about the unfortunate incident can still not fathom how such an incident occured.

“A day before we went to Ada, Castro came to my house and said he was on his way to Kumasi and would not join us. But whilst we were on our way to Ada, on the Accra – Tema motorway, we received a phone call that “under”(Castro) wants us to wait for him”, Gyan said

“We parked at a fuel station where a crowd gathered to catch glimpse of me. I later got the inclination it was destined to happen because he was initially not part of the trip. when we got to Ada, everything went fine. We were to spend three days, but ended up using the Jetski on the second day”, he added.
