Hospital faces lawsuit after CCTV found in breast exam room

On June 2, 2025, Gifty Amoakowaa filed a lawsuit against Peace and Love Hospital in Accra, alleging that the installation of CCTV cameras in consultation and examination rooms used for breast examinations infringes upon her constitutional rights to privacy and dignity.

The case, brought before the High Court, contends that such surveillance violates Articles 15 and 18(2) of Ghana’s 1992 Constitution, as well as provisions of the Public Health Act, 2012 (Act 851), particularly the Patients’ Charter, which upholds the confidentiality of patient information.

Amoakowaa asserts that the presence of surveillance equipment in private medical spaces constitutes a breach of the confidential nature of the doctor-patient relationship.

She further claims to have suffered psychological trauma and emotional distress due to what she describes as an unjustifiable intrusion into her private medical experiences.

The applicant seeks a declaration that CCTV use in breast examination rooms is unlawful and violates her constitutional rights.

She requests the immediate removal of all such cameras in the hospital’s facilities, deletion and non-dissemination of any related footage, compensation for emotional harm, and legal costs.

The case underscores the tension between security measures in healthcare settings and the imperative to protect patient privacy and confidentiality.

As of now, Peace and Love Hospital has not publicly responded to the lawsuit.
