Supreme Court to rule on Akwatia MP’s injunction and contempt case on April 30

The Supreme Court of Ghana is set to decide on Wednesday, April 30, 2025, whether to overturn the Koforidua High Court’s injunction against Akwatia MP Ernest Yaw Kumi and quash the contempt ruling issued against him.

Legal Arguments Before the Supreme Court

During the hearing, legal representatives for both parties presented their cases:

MP Ernest Yaw Kumi’s Counsel, Gary Nimako Marfo, argued:

  • The High Court erred in granting the injunction without a gazette notification of the election results.
  • The judge wrongly relied on a news article to assume that the Electoral Commission (EC) had gazetted the election.
  • The contempt ruling was improper since applications were pending before the Supreme Court.

NDC Candidate Henry Boakye Yiadom’s Lawyer, Bernard Bediako Baidoo, countered:

  • A physical copy of the gazette was not necessary for the case to proceed.
  • Filing a certiorari application did not automatically halt High Court proceedings.
  • The High Court lawfully exercised its jurisdiction in handling the contempt case.
