Supreme Court to deliver judgment on celebrity alcoholic advert ban on April 10

The Supreme Court has fixed April 10, 2024 to deliver judgement on the case in which Mark Darlington Osae has filed a suit against directives that banned celebrities in alcoholic advertisements.

The Food and Drugs Authority (FDA), had issued a directive that placed a ban on celebrities from advertising for alcoholic beverages.

A seven member panel of the apex Court chaired by Chief Justice, Gertrude Torkornoo on Wednesday, January 17, fixed the date after hearing all parties in the matter.

With the exception of the Counsel for the Applicant, Bobby Banson who pointed to the panel of one other authority to add, the rest of the FDA represented by Justine Amenuvor and a Senior State Attorney for the Attorney General’s Office all relied on their statement of cases and processes filed.

The panel consequently fixed April 10, 2024 for judgement.

A few of the celebrities were present in court compared to the last sitting on November 15, 2023.

Sammy Awuku, the Director General of the National Lottery Authority who is with the legal team of the Applicant was present at the Supreme Court.

Background

The FDA’s directives which barred the use of celebrities in plugging alcoholic beverages was aimed at protecting minors from being influenced by celebrities into alcoholism.

Mark Osae, the manager of Reggie ‘N’ Bollie and Skrewfaze dissatisfied with the directive issued a writ at the Supreme Court on November 11, 2022, saying the FDA’s 2015 regulations are discriminatory against the creative arts industry.

The plaintiff (Mark Darlington Osae), also a music publisher at Perfect Note Publishing, wants the Supreme Court to take down that regulation.

Mark Osae, who is the Chairman and Co-Founder of Ghana Music Alliance, said  the FDA directive which ordered that, “no well-known personality or professional shall be used in alcoholic beverage advertising,” is inconsistent with and in contravention of articles 17(1) and 17 (2) of the 1992 Constitution.

He contended that, Articles 17(1) and 17 (2) of the 1992 Constitution guarantee quality before the law and prohibit discrimination against persons on grounds of social or economic status, occupation, among others, and consequently null, void, and unenforceable.

Before the action was initiated at the Supreme Court, some of the stakeholders in the creative industry including, Wendy Shay, Shatta Wale, Brother Sammy, Kuami Eugene, and Camidoh, had all spoken against the law and had called on powers that be to repeal it.

The FDA’s directives discourage the use of celebrities in the promotion of alcoholic beverages via any medium.

This policy forms part of the efforts by the government of Ghana to protect children and young people from alcohol marketing.

But the plaintiff ignores this reality and argues that the child protection measure would rob the entertainment industry of potential streams of income.

In the writ issued on November 11, the plaintiff, Mark Darlington Osae said those areas of the FDA’s 2015 regulations are tantamount to discrimination on grounds of economic status, and occupation among others.

The artist, manager, and music publisher is thus asking the Supreme Court to render as unconstitutional the guidelines which stipulate that, “No well-known personality or professional shall be used in alcoholic beverage advertising.” Mr Darlington Osae is the Chairman and Co-Founder of Ghana Music Alliance.

Reliefs

(a).A declaration that on a true and proper interpretation of Article 17(1) and (2) which guarantee equality before the law and prohibits discrimination against persons on grounds of social or economic status, occupation, among others, Guideline 3.2.10 of the Guidelines for the Advertisement of Foods published by the 1st Defendant on 1st February 2016 which provides that “No well-known personality or professional shall be used in alcoholic beverage advertising” is discriminatory, inconsistent with and in contravention of articles 17(1) and 17 (2) of the 1992 Constitution, and thus unconstitutional.

(b). A declaration that on a true and proper interpretation of Article 17(1) and (2), Guideline 3.2.10 of the Guidelines for the Advertisement of Foods published by the 1st Defendant on 1st February 2016 which prohibits well known personalities and professionals from advertising alcoholic products is inconsistent with and in contravention of articles 17(1) and 17 (2) of the 1992 Constitution which guarantee equality before the law and prohibits discrimination against persons on grounds of social or economic status, occupation amongst others and consequently null, void and unenforceable.

(c). An order striking down Guideline 3.2.10 of the Guidelines for the Advertisement of foods published by the Ist Defendant on Ist February 2016 as being inconsistent with and in contravention of the letter and spirit of the 1992 Constitution and as such a nullify.

(d). An order of perpetual injunction restraining the Defendants, their agents or servants or assigns under the pretest of acting under Guideline 3.2.10 of the Guidelines for the Advertisement of foods published by the 1st Defendant on Isl February 2016 from doing anything to prevent any well-known personality or professional from advertising alcoholic products.

Cedi weakens by 1.22 per cent; one dollar going for ¢12.30

The cedi weakened 1.22% to the US dollar in the retail market last week, following depreciation pressures.

It also lost 0.65% to the pound and 0.19% against the euro on the retail market, despite Ghana’s inflation cooling to 23.2% in December 2023.

Though the Central Bank auctioned 20 million dollars for the Bulk Oil Distribution Companies in its first sale for 2024, it failed to tame the persistent corporate demand.

The cedi closed trades on the retail market or the forex bureaus at GH¢12.33/$ against GH¢12.18/$ the previous week.

However, many analysts believe the expected $600 million inflows from the International Monetary Fund (IMF) after its board approval of the first review of Ghana’s programme this Friday, January 19, 2024, should help improve market sentiments.

This will consequently shore up foreign exchange reserves and strengthen supply-side intervention.

Government last Friday, January 12, 2024, reached debt restructuring agreements with its official creditors, a move seen by many as a step in Ghana’s economic recovery.

So far this year, the local currency has lost about 1.50% in value to the dollar in the retail market.

Dampare sponsoring campaign against COP Alex Mensah – Oheneba alleges

Television broadcaster Oheneba Boamah Bennie has fingered the Inspector General of Police (IGP) Dr George Akuffo Dampare in a smear campaign against COP Alex George Mensah (RTD).

Showing pictures of some Toyota Land cruisers on the Gumbe show on TV XYZ, the TV anchor revealed that IGP Dampare had clandestinely sponsored some persons to thwart the parliamentary bid of Mr Mensah who has declared to contest in the parliamentary primary of the governing New Patriotic Party (NPP) for Bekwai in the Ashanti Region.

COP Mensah (RTD) is said to be the favorite of the party delegates following the exit of the MP of the area, Joseph Osei Owusu.

Despite being the favourite of the grassroots of the party, Oheneba said Dampare had sent some persons to the constituency last week to secretly meet with the opponents of COP Mensah (RTD) to support them to defeat the former police officer.

The said action, he said, stems from the revelations COP Alex Mensah made against Dampare during the Parliamentary Committee hearing that sought to investigate the IGP.

During the hearing which happened in the back of a leaked tape about the IGP’s style of managing the Police Service, Mr Mensah stated categorically that Dampare was the worse IGP he had seen in his over 3 decades of working in the service.

COP Alex Mensah, in his assertions at the committee did not mince words about Dampare’s leadership style and suggested he be changed.

In one his submissions, he said the morale of officers had dwindled because of Dampare’s “autocratic” leadership style.

Although the findings of the committee is not out yet, Oheneba reveals that the delegation Dampare allegedly sent to Bekwai had one of the IGP’s driver and one Nana Osei Afriyie.

“IGP Dampare, we know where the people you sent to Bekwai slept. One of the people is said to be a police officer in uniform who has been identified as your driver, ” Oheneba stated.

To him it is wrong for the IGP to meddle in politics, stressing that COP Mensah retired before venturing into partisan politics publicly.

” IGP is dangerous. What he is doing is bad and must be investigated by the NIB, ” he added.

‘No Ghana Card, No Salary’ initiative is unfair – GFL to Govt

The Ghana Federation of Labour (GFL) has urged the government to collaborate with the National Identification Authority (NIA) to register public workers who do not have Ghana cards.

The Secretary General of the GFL, Mr Abraham Koomson, who made the suggestion indicated that there are many public workers who have not been able to register for the Ghana Card because of technical challenges.

Mr Koomson’s concerns come at a time the Controller and Accountant General’s Department (CAGD) has announced that public workers who do not have Ghana Card will not receive their monthly salaries beginning from February this year.

Speaking to Oheneba Boamah Bennie on TV XYZ Wednesday evening, Mr Koomson argued that many public workers had not been able to acquire their Ghana Cards due to technical challenges, condemning the government’s decision to freeze the salaries of public workers who do not have Ghana Cards.

Mr Koomson said although the move by the government was to sanitize the public payroll, the approach was wrong.

“We know some unscrupulous people have been using the names of persons who have died to draw salaries on the government’s payroll but this approach will not help, ” he said while advising the government to review its approach.

According to Mr Koomson, “the government should ensure that all public workers have the Ghana card through a new registration exercise for all government workers.”

“The government must collaborate with NIA to register workers in their offices so productivity does not come down,” Mr Koomson stated.

” CLOGSAG should demonstrate against the approach if the government does not help its members to get the card,” Koomson urged.

Last year, the Controller and Accountant General’s Department (CAGD) said from the beginning of February 2024, all public sector workers without Ghana Card numbers will have their salaries frozen.

The directive issued by the Controller and Accountant General’s Department (CAGD) was part of its measures to help cut out ghost names on the government’s payroll.

Special Prosecutor arrests NEIP CEO Kofi Nkansah for alleged money distribution

Chief Executive of the National Entrepreneurship and Innovation Programme (NEIP), Kofi Ofosu Nkansah has been arrested by the Office Special Prosecutor on charges of distributing money to delegates ahead of the NPP Parliamentary primaries.

The arrest follows a complaint filed by Kwame Anyimadu Antwi, Mr. Nkansah’s rival for the Asante Akim Central parliamentary seat.

The NPP’s Asante Akim Central constituency secretary, Felix Amakye told Accra-based Citi FM that Anyimadu Antwi brought the alleged money-sharing incident to the attention of the Special Prosecutor.

Subsequently, Mr. Nkansah was taken to the OSP’s office to assist in investigations.

Meanwhile, Kwame Anyimadu Antwi has refuted claims of reporting the NEIP boss to the Office of the Special Prosecutor.

So far, the party has cleared 326 parliamentary aspirants for the January 27 primaries to elect its parliamentary candidates in constituencies where the party has sitting MPs.

Out of the total number of 373 aspirants, who filed to contest the primaries, after vetting, 29 are going unopposed, 11 were disqualified, two were referred to the National Executive Committee (NEC), two stepped down, one incomplete form and two did not show up for vetting leaving the qualified aspirants for the primaries at 326.

GPRTU suspends 60% fare increment

The Ghana Private Road Transport Union (GPRTU) has suspended the decision increase transport fares by 60 per cent.

The biggest transport union had earlier announced its decision to implement a 60% increase in transport fares in 2024, following the introduction of the Emission Levy Bill in January 2024.

But in an interview with Piesie Okrah on TV XYZ midday news, the Public Relations Officer for GPRTU, Abass Imoro, said the increment of the fares had been “put on hold for a while.”

He explained that the actual time to effect the increase in fares had not been determined yet, adding the Union has petitioned the Speaker of Parliament on the Emission Levy Bill.

He said the bill will overburden drivers especially when the prices of spare parts had been increased.

“The Abossey Okai spare parts dealers have increased their prices due to high import charges so the increase in fares will happen but we are holding on a bit due to the petition,” Imoro said in Akan.

He continued, ” if nothing is being done or nothing can be done about these levies, then we will come out with an upward adjustment of lorry fares not less than 60%.”

About the Emissions Levy Bill 

The recently passed Emissions Levy Bill by Parliament imposes an annual fee of 100 cedis on all owners of petrol and diesel cars, starting from January 2024.

The government aims to promote the use of environmentally friendly energy sources for vehicle power through this tax, aligning with its commitment to climate-positive actions and carbon offset initiatives.

In response to these developments, the GPRTU has petitioned the Speaker of Parliament, urging a reconsideration of the Emission Levy Bill.

Nitiwul is a bird; he shouldn’t try anything nasty during elections – Lante Vanderpuye

The Member of Parliament for Ododiodoo, Edwin Nii Lantey Vanderpuye, has warned the Minister for Defence, Dominic Nitiwul, to desist from trying any intimidation tactics during the 2024 general elections.

The former Sports Minister who was speaking on Dwaboase on Power FM cautioned that should Nitiwul take advantage of his position in government to foment any political unrest in bid to help the NPP government hold on to power, he will not like the reaction of the opposition NDC.

Vanderpuye’s comment follows a recent statement made by the Defence Minister who is also the Bimbia MP seeking to scare the NDC fanatics in the constituency.

Ahead of the parliamentary primaries of the governing New patriotic Party (NPP), Nitiwul, who is being contested by Alhaji Ahmed Nuhu Zaruk, stated that he would use his contender to teach the opposition National Democratic Congress (NDC) a great lesson during the 2024 polls.

“I say that they should let that gentleman contest because they say the gentleman has not filled out the form…Let him fill out the form properly and allow him to contest the election, and we will see how I will treat him in the constituency. I will use him to show the NDC what I will do to them in 2024. Tell him I will use him to test what I will do to the NDC in the 2024 election,” Nitiwul stated after his vetting.

Dominic Nitiwul, the Defence Minister

The statement has raised concerns within the rank and file of the NDC, with some interpreting it as a warning about unrests that the NPP government has planned to orchestrate during the elections.

But reacting to the statement from Nitiwul, the MP for Odododiodoo sent a strong signal to the Defence Minister not to dare try anything that will lead to chaos else he will be faced squarely by Ghanaians.

To him, the NPP government has failed miserably and Ghanaians are impatiently waiting to vote against them on December 7 this year.

“Nitiwul is a bird. He is a young boy; he shouldn’t try anything nasty because he will be dealt with,” Vanderpuye told host Kwame Minkah.

Declining to go into details, the former pugilist said, “If I spit on him, his feathers will be wet. He should not try to cause trouble in any form either through the military or the police. He will hear from us. This is the reason I have left Parliament.”

December inflation drops to 23.2% from 26.4%

Ghana’s inflation has dropped for the fifth consecutive month, recording a rate of 23.2% for December 2023.

This means that in December 2023 the general price level was 23.2 percent higher than in December 2022

According to the Consumer Price Index (CPI) data released on Wednesday, January 10, food inflation stood at 28.7 percent and non-food inflation recorded 18.7 percent.

Inflation for locally produced items stood at 23.8 percent while inflation for imported items stood at 21.9 percent.

On the regional front, the Eastern region recorded the highest food inflation rate of 51.3 percent while the Upper East recorded the lowest food inflation rate of 18.8 percent.

Greater Accra placed 14th among the 16 regions recording a food inflation rate of 22.2 percent.

GPRTU to increase fares by 60%

In response to these developments, the GPRTU has petitioned the Speaker of Parliament, urging a reconsideration of the Emission Levy Bill.

In an interview with Citi News, Abbas Imoro, the Public Relations Officer for GPRTU, expressed concerns about the additional tax burden on the union, citing existing financial challenges.

“We are already paying for the emission, 10 pesewas for a litre. So you can imagine 10 pesewas by 4.5 for a gallon by several gallons you use a day times 26 working days in a month. You can imagine how much one driver pays for it. And we pleaded with parliament that they should have a second look at it.

“But we did indicate that if nothing is being done or nothing can be done about it, then of course we have other problems as well. We will package ourselves and come out with an upward adjustment of lorry fares not less than 60%,” he said.

OSP justifies action against Cecilia Dapaah over stolen money

The Special Prosecutor, Kissi Agyebeng, has disclosed that the decision by his office to investigate the source of the missing huge sums of money belonging to former Sanitation Minister, Cecilia Dapaah was a result of the case brought against her domestic staff by the Attorney General.

Mr. Agyebeng clarified that while the Attorney General, on behalf of the government, was investigating and prosecuting her house helps for the missing money, the Office of the Special Prosecutor (OSP) also came in to probe the source of the over $1 million and other valuables stolen from the former minister’s Abelemkpe residence.

Speaking on The Point of View on Citi TV on Monday, January 8, Agyebeng indicated that the OSP approached the Attorney General and collaborated to find the truth on the matter.

“From the OSP’s perspective, we are looking at what is the source of this money, and where is the money coming from. That this huge sum of money is sitting in a public officer’s house.”

“On this matter, we approached the Attorney General and said we were interested in what was going on at the other end, and that we were following up on it. Incidentally, it was actually the court processes filed by the Attorney General in respect of the theft case that propelled the investigation. We became interested when we saw those court processes.”

He also said the work of the Attorney General actually enhances the OSP’s investigations rather than hampers it.

“It [the Attorney General’s case] doesn’t hamper our work; it rather enhances our work because if you are tracing whether someone actually stole this amount of money and the other end is investigating the source of the money, we are all going toward a comprehensive solution to the matter.”

It emerged in July 2023 that two house helps of Cecilia Abena Dapaah and her husband, Daniel Osei Kuffour, were dragged before an Accra Circuit Court, for allegedly stealing monies and items running into millions of Ghana Cedis.

Cecilia Dapaah was forced to resign a day after the story broke, and her residence was searched by officials from the Office of the Special Prosecutor (OSP).

Cheddar: Man behind ‘New Force’ mask says he’s Ghana’s political saviour

Ghanaian business man, Nana Kwame Bediako also known as Cheddar, has revealed that he is the elusive man in mask found on billboards in many parts of the country announcing a new political movement – The New Force.

In a press conference on Sunday, January 7,2023, the man whose billboards got Ghanaians wondering for months officially unveiled his entry into Ghana’s political space and said he is the new saviour to redeem Ghana from bad leadership.

His press conference follows the government of Ghana’s 11th-hour cancellation of a rally he had organised dubbed ‘The Convention 2024’ scheduled to be held at the Independence Square in Accra.

Renowned African speakers who were assembled to address Ghanaians at the rally organised by Bediako’s ‘The New Africa Foundation’ were Professor PLO Lumumba, Dr. Arikana Chihombori-Quao from Zimbabwe and Nigerian politician Peter Obi.

These thought leaders were to speak on key challenges confronting Africa’s development.

But Kwame Bediako said he was no one to be scared of because he had embarked on that journey to salvage Ghana and Africa.

Touching on his vision for Ghana, Cheddar said, “I am nothing to be scared of. I came to you as your salvation. I don’t invest in myself alone. I am investing in you.”

He said he started the fight for development for the country for the past 21 years, adding that he is dedicated to the cause.

“We need to educate. We need to uplift our children. We need to voice out to them. You are about to find out about this man in the mask because I never spoke a word, you were looking for me. I didn’t tell you whether I am into politics, whether I am an evangelist, whether I am a conventionist or a revolutionist. After this day, you will have to wait for me to share my policies and my visions with you.

“And if I’m the reason why the country or the government is not happy about these great voices coming to educate not only Ghana, but also Africa, then I take this moment to sacrifice myself, to unveil myself, because I have much respect for these great leaders beside me. I would have taken my own time to tell you that I am. But for this very moment, I am sacrificing myself to let you know that I’m that man.

To Cheddar, he is the “man with a good purpose, with a great vision” who has a plan that will accelerate the growth of the country.

“I have a vision for this nation. And not only this nation, I have it for Africa too. But I know Africa is the next biggest thing because out of all the continents that have been developed in this world, there is only one continent that is not developed and I am sent to do that,” he stated.

Renowned preacher TB Joshua raped and tortured worshippers – BBC finds

Evidence of widespread abuse and torture by the founder of one of the world’s biggest Christian evangelical churches has been uncovered by the BBC in a recent explosive exposé.

Dozens of ex-Synagogue Church of all Nations members – five British – allege atrocities, including rape and forced abortions, by Nigeria’s late TB Joshua.

The allegations of abuse in a secretive Lagos compound span almost 20 years.

The Synagogue Church of All Nations did not respond to the allegations but said previous claims have been unfounded.

TB Joshua, who died in 2021, was a charismatic and hugely successful preacher and televangelist who had an immense global following.

The BBC’s findings over a two-year investigation include:

  • Dozens of eyewitness accounts of physical violence or torture carried out by Joshua, including instances of child abuse and people being whipped and chained
  • Numerous women who say they were sexually assaulted by Joshua, with a number claiming they were repeatedly raped for years inside the compound
  • Multiple allegations of forced abortions inside the church following the alleged rapes by Joshua, including one woman who says she had five terminations
  • Multiple first-hand accounts detailing how Joshua faked his “miracle healings”, which were broadcast to millions of people around the world

One of the victims, a British woman, called Rae, was 21 years old when she abandoned her degree at Brighton University in 2002 and was recruited into the church. She spent the next 12 years as one of Joshua’s so-called “disciples” inside his maze-like concrete compound in Lagos.

“We all thought we were in heaven, but we were in hell, and in hell terrible things happen,” she told the BBC.

Rae says she was sexually assaulted by Joshua and subjected to a form of solitary confinement for two years. The abuse was so severe, she says she attempted suicide multiple times inside the compound.

The Synagogue Church of All Nations [Scoan] has a global following, operating a Christian TV channel called Emmanuel TV and social media networks with millions of viewers. Throughout the 1990s and early 2000s, tens of thousands of pilgrims from Europe, the Americas, South East Asia and Africa travelled to the church in Nigeria to witness Joshua performing “healing miracles”. At least 150 visitors lived with him as disciples inside his compound in Lagos, sometimes for decades.

More than 25 former “disciples” spoke to the BBC – from the UK, Nigeria, US, South Africa, Ghana, Namibia and Germany – giving powerful corroborating testimony about their experiences within the church, with the most recent experiences in 2019. Many victims were in their teens when they first joined. In some of the British cases, their transport to Lagos was paid for by Joshua, in co-ordination with other UK churches.

Rae and multiple other interviewees compared their experiences to being in a cult.

Jessica Kaimu, from Namibia, says her ordeal lasted more than five years. She says she was 17 when Joshua first raped her, and that subsequent instances of rape by TB Joshua led to her having five forced abortions while there.

These were backdoor type… medical treatments that we were going through… it could have killed us,” she told the BBC.

Other interviewees say they were stripped and beaten with electrical cables and horse whips, and routinely denied sleep.

On his death in June 2021, TB Joshua was hailed as one of the most influential pastors in African history. Rising from poverty, he built an evangelical empire that counted dozens of political leaders, celebrities and international footballers among his associates.

He did, however, attract some controversy during his lifetime when a guesthouse for church pilgrims collapsed in 2014, killing at least 116 people.

The BBC’s investigation, which was carried out with international media platform Open Democracy, is the first time multiple former church insiders have come forward to speak on the record. They say they’ve spent years trying to raise the alarm, but have effectively been silenced.

A number of our witnesses in Nigeria claim they were physically attacked, and in one case shot at, after previously speaking out against the abuse and posting videos containing allegations on YouTube.

footage of the church’s Lagos compound from a public street in March 2022 was also fired at by the church’s security, and was detained for a number of hours.

The BBC contacted Scoan with the allegations in our investigation. It did not respond to them, but denied previous claims against TB Joshua.

“Making unfounded allegations against Prophet TB Joshua is not a new occurrence… None of the allegations was ever substantiated,” it wrote.

Four of the British citizens who spoke to the BBC say they reported the abuse to the UK authorities after escaping the church. They say no further action was taken.

In addition, a British man and his wife emailed eyewitness accounts of their ordeal and video evidence – including recordings of being held at gunpoint by men describing themselves as police who are also members of Scoan – to the British High Commission in Nigeria in March 2010 after fleeing the church. In his email, the man said his wife had been repeatedly sexually assaulted and raped by Joshua. He warned the commission that other British nationals were still inside the compound facing atrocities.

He also says no action was taken.

The UK Foreign Office did not respond to these claims, but told the BBC that it takes all reports of crime, including sexual assault and violence against British nationals overseas, very seriously.

Scoan continues to thrive today, under the leadership of Joshua’s widow, Evelyn. In July 2023, she led a tour of Spain.

Anneka, who left Derby in the UK to join Scoan at the age of 17, told the BBC she believes there are many other victims who have yet to speak out. She hopes further steps will be taken to uncover Joshua’s actions.
