Ambulance Trial: Judge to decide on injunction application by Ato Forson on Thursday

The High Court Judge hearing the controversial ambulance case has set Thursday, June 6 to deliver a ruling on whether to halt the prosecution of the Minority Leader, Cassiel Ato Forson and the other accused person in the case, Richard Jakpa.

The two accused, filed separate applications seeking to injunction their prosecution on account of the damning allegations made by the third accused person, Richard Jakpa, against the Attorney General and Minister of Justice, Godfred Yeboah Dame, that he coerced him(Mr Japka) to falsify testimony against Ato Forson to get him jailed and that the Attoney General said he was under pressure to prosecute the former Deputy Finance Minister, who is now the MinorityLeader of Parliament.

You will recall that during cross-examination, Mr. Jakpa accused the Attorney General of contacting him at odd hours to implicate Ato Forson.

After that, the NDC aired an audio conversation between Richard Jakpa and Godfred Dame to substantiate the allegations.

Lawyers of Ato Forson then filed an application praying the court to declare a mistrial while Richard Jakpa filed an application asking the court to strike out charges against them.

 

Before the filing of these applications, lawyers of Ato Forson had filed an application for a stay of proceedings pending an appeal of a ruling of the court.

This ruling compelled lawyers of Ato Forson to cross-examine Richard Jakpa before the Attorney General undertakes his cross-examination.

Justice Afia Serwah Asare-Botwe noted when the case was called for hearing that she would deliver rulings on all applications on the next adjourned date this Thursday.

The judge, however, allowed for counsel for the third accused, Richard Jakpa, to raise objections to aspects of a sworn statement from the office of the Attorney General opposing his application for the charges to be struck out.

Thaddeus Sory who represents Mr Jakpa argued that the facts in the Attorney General’s affidavit were deposed to by a principal state Attorney who has no personal knowledge of the facts. He argued that the said principal state Attorney did not show how he attained knowledge of the facts deposed to.

Attorney General Godfred Yeboah Dame, however, opposed the objection on grounds that the principal state attorney knows the facts as deposed to in paragraph one of the sworn statements which states that the principal state attorney obtained knowledge of the facts in the line of his duty.

Godfred Dame further asserts that the objection is ill-moved as the best way to challenge the paragraphs was for the accused to have deposed to affidavits challenging the facts and not to object on points of law.

MultiChoice Announces Head Judge and a Date for 10th AMVCA

“The AMVCA has established itself as the benchmark for excellence in the African film industry. This edition is not just the celebration of excellence in filmmaking, but also a heritage of an award that has improved careers and boosted talent development on the continent”.

Dr. Tejumola further disclosed that the pool of quality entries this year will be a significant task the jury and head judge to review.

“For this edition, we received entries from films and talent across Africa. Shortlisting has begun and we will now move to the judging phases. For this special edition, we are making changes to the award categories. The Best Actor and Best Actress, as well as Best Supporting Actor and Actress categories will now be determined by the jury. We are also delighted to announce ace filmmaker, director and producer, Femi Odugbemi, as the Head Judge for the 10th AMVCA.

Judge proposes plea bargain as court sets December 20 for NAM 1 trial

After almost five years since the CEO of defunct dealership firm Menzgold, Nana Appiah Mensah was charged with selling gold without license, defrauding and various counts of money laundering, an Accra High Court has set December 20 to begin his trial.

Outlining the legal options available to the accused, Justice Owusu Dapaah explained to lawyers of the NAM 1 that they could explore a plea bargain since the case is a financial one.

Plea bargains are agreements between defendants and prosecutors in which defendants agree to plead guilty to some or all of the charges against them in exchange for concessions from the prosecutors
During a case management conference in court on Tuesday, December 12, Director of Public Prosecutions Yvonne Attakorah Obuobisa noted that the state will call eleven witnesses for their evidence during the trial.

The witnesses include Stephen Attipoe (Prosecution Witness 1), Lady Darling Tuffour (PW2), Dr Niikoi Annan (PW3), Edward Otu Larbi (PW4), Fred Odame Asiedu (PW5), and Francis Agodzi (PW6).
The remaining are Benjamin Baffoe (PW7), Rhoda Fofo Kormey(PW8), Rose Ocran (PW9), Priscilla Adu Boateng (PW10), DSP Charles Nyarko (PW11).
After an assessment of the roadmap of the prosecution by counsel for Nana Appiah Mensah also known as NAM 1 and state prosecutors, the court noted that thirty-five (35) hours will be used.

This will consist of witness statements and cross-examinations of the defendant’s counsel.
Presiding judge Dr Ernest Owusu-Dapaah indicated that there will be a daily trial of the former Menzgold boss in January, 2024.

“Scheduled dates for hearing in January 2024:

15th January – 1pm, 16th January – Morning, 17th January – 9am, 18th January – 9am and 19th January – 9am after which subsequent dates will be decided”
He added that he hoped the judgement for the trial would be ready in March, 2024.
Nana Appiah Mensah pleaded not guilty to 39 counts of new charges proffered against him by the state on December 8.

Chief Justice dismisses judge for having affair with petitioner in divorce case; causing her arrest

Chief Justice, Gertrude Sackey Torkornoo acting on a decision by the Judicial Council has dismissed the Circuit Court for Jasikan, Alfred Kwabena Asiedu.

Myxyzonline has chanced on his dismissal letter dated 13th November, 2023 in which the Chief Justice clearly stated the decision by a Disciplinary Committee, whose report established abuse of power, malicious prosecution and impropriety by Justice Alfred Asiedu.

It said the Judicial Council, upon review of the findings at a meeting held on 25th October, 2023, agreed his conduct constituted misbehaviour, in the case involving one Singari Daina Sadia and subsequently resolved unanimously to dismiss him, (Justice Alfred Kwabena Asiedu), from office as a Circuit Court Judge with immediate effect, in line with Article 151(1) of the 1992 Constitution.

He is to hand over all official properties including official vehicle, records and docket books to the Judicial Secretary.
