Ambulance Trial: Judge to decide on injunction application by Ato Forson on Thursday

The High Court Judge hearing the controversial ambulance case has set Thursday, June 6 to deliver a ruling on whether to halt the prosecution of the Minority Leader, Cassiel Ato Forson and the other accused person in the case, Richard Jakpa.

The two accused, filed separate applications seeking to injunction their prosecution on account of the damning allegations made by the third accused person, Richard Jakpa, against the Attorney General and Minister of Justice, Godfred Yeboah Dame, that he coerced him(Mr Japka) to falsify testimony against Ato Forson to get him jailed and that the Attoney General said he was under pressure to prosecute the former Deputy Finance Minister, who is now the MinorityLeader of Parliament.

You will recall that during cross-examination, Mr. Jakpa accused the Attorney General of contacting him at odd hours to implicate Ato Forson.

After that, the NDC aired an audio conversation between Richard Jakpa and Godfred Dame to substantiate the allegations.

Lawyers of Ato Forson then filed an application praying the court to declare a mistrial while Richard Jakpa filed an application asking the court to strike out charges against them.

 

Before the filing of these applications, lawyers of Ato Forson had filed an application for a stay of proceedings pending an appeal of a ruling of the court.

This ruling compelled lawyers of Ato Forson to cross-examine Richard Jakpa before the Attorney General undertakes his cross-examination.

Justice Afia Serwah Asare-Botwe noted when the case was called for hearing that she would deliver rulings on all applications on the next adjourned date this Thursday.

The judge, however, allowed for counsel for the third accused, Richard Jakpa, to raise objections to aspects of a sworn statement from the office of the Attorney General opposing his application for the charges to be struck out.

Thaddeus Sory who represents Mr Jakpa argued that the facts in the Attorney General’s affidavit were deposed to by a principal state Attorney who has no personal knowledge of the facts. He argued that the said principal state Attorney did not show how he attained knowledge of the facts deposed to.

Attorney General Godfred Yeboah Dame, however, opposed the objection on grounds that the principal state attorney knows the facts as deposed to in paragraph one of the sworn statements which states that the principal state attorney obtained knowledge of the facts in the line of his duty.

Godfred Dame further asserts that the objection is ill-moved as the best way to challenge the paragraphs was for the accused to have deposed to affidavits challenging the facts and not to object on points of law.

2. PLAN B: EC says i am limiting registration to district office far from the convention and the law (its mandate and the constitution) all cries, pleas snubbed – and we saw the bussing to district office regardless of hard to reach areas .. and that’s implemented today

3. PLAN C: Missing BVDs found out, denials and admissions. Then a decision to pick serial numbers is condemned but EC WILL EVENTUALLY realize it’s too late

4. PLAN D: Test the system … wrong figures on registers voters and the COREL draw story ..

5. PLAN E: A Police statement ordering Commanders to ensure that no one challenges people bused to register when it’s clear they are from other regions … how possible? YES !!! Because if the registration were to be at the polling stations.. you an I could easily identify neighbors and challenge.. so the fertile ground was laid long before

6. PLAN F: The gerrymander game: EC says no party agents allowed – NPP says they are right. Right?

Outcomes from the Emergency IPAC Meeting held Yesterday & President Mahama’s Directive

The Electoral Commission is to reconsider their decision on ‘No agents of political parties’ at the centres where the voter transfers are taking place and revert to political parties.

At IPAC, NDC emphasised the need for the EC to prioritise and expedite the decision making process.

Meanwhile, we insisted that our NDC agents will not be withdrawn.

NB:

The EC’s reason for asking for withdrawal of agents is that the agents were causing trouble and chaos at the centres. We debunked that assertion and asked the EC to distinguish between causality and causal associations.

Furthermore, note that the NPP supports the EC’s decision not to allow agents at centres to observe the transfers. Obviously to aid NPP’s gerrymandering!

Collusion between EC and NPP!

I have attached a document to show how NPP intends to transfer votes within Ashanti region into what the NPP terms “UNSAFE CONSTITUENCIES”: New Edubiase, Ejura Sekyedumase, Sekyere Afram Plains, Ahafo Ano North and Ahafo Ano South West.

On the EC’s intention to mount outfits on the University campuses for Transfer only to the constituencies where the universities are located:

Those who registered in May 2024 are legally not illegible to transfer. But those who registered in 2023 and 2020 can.

However, IPAC asked the EC to back their desire to mount transfer centres on university campuses with data. The EC agreed to revert.

As President John Dramani Mahama has emphasised, “no amount of collusion between the Electoral Commission and the NPP can rescue the NPP on December 07, 2024.”

Mr. Mahama adds, “We have instructed our party at all levels to continue to be present and observe the transfer process. I challenge the EC leadership to live up to its expected mandate and stop working in the interest of the ruling party.”

Liverpool, Arsenal and Man City chase Newcastle’s Guimaraes

Liverpool, Arsenal and Manchester City are keen to sign Newcastle’s Bruno Guimaraes this summer, according to Spanish outlet AS.

Newcastle are reported to be considering sanctioning a sale of one of their biggest assets to meet Profitability and Sustainability Rules this summer.

Guimaraes is said to have a release clause of around €115m (£98.1m), although the Magpies could accept a fee closer to €80m (£68.2m).

City met with Guimaraes’ representatives in January, while their interest in Lucas Paqueta, his Brazil team-mate, has waned due to his FA charge of alleged breaches of betting rules.

Arsenal are keen to upgrade on Jorginho and Thomas Partey at the base of their midfield, while Liverpool see Guimaraes as a potential marquee signing for Arne Slot, the new head coach.

Bayern Munich open talks with Manchester United midfielder Bruno Fernandes

Bayern Munich have opened talks with the agent of Bruno Fernandes, according to reports.

Portuguese outlet O Jogo say the Bundesliga side have contacted the Manchester United midfielder’s representative Miguel Pinho.

Barcelona are also said to be interested in the Portugal star and they could soon open negotiations.

Fernandes, 29, has been at United for five seasons, scoring 79 goals and contributing 65 assists in 232 appearances since joining from Sporting Lisbon.

His contract is set to expire in the summer of 2026.

Claudia Sheinbaum elected as Mexico’s first female president

Claudia Sheinbaum is projected to win Mexico’s presidential election and become its first female president in history.

“I will become the first woman president of Mexico,” Sheinbaum said at a downtown Mexico City hotel shortly after electoral authorities announced a statistical sample showed she held an irreversible lead, according to the Associated Press. “I don’t make it alone. We’ve all made it, with our heroines who gave us our homeland, with our mothers, our daughters and our granddaughters.”

The former Mexico City mayor said that her two competitors – Xóchitl Gálvez and Jorge Álvarez Máynez – had called her and conceded.

The National Electoral Institute’s president said Sheinbaum had between 58.3% and 60.7% of the vote, according to a statistical sample. Opposition candidate Gálvez had between 26.6% and 28.6% of the vote and Álvarez Máynez had between 9.9% and 10.8% of the vote. Sheinbaum’s Morena party was also projected to hold majorities in both chambers of Congress.

Sheinbaum, the AP reports, will also be the first Jewish leader of the overwhelmingly Catholic country.

She will start her six-year term on Oct. 1. Mexico’s constitution does not allow reelection.

The leftist has said she believes the government has a strong role to play in addressing economic inequality and providing a sturdy social safety net, much like her political mentor President Andrés Manuel López Obrador, who is also a member of the Morena party.

“Of course, I congratulate Claudia Sheinbaum with all my respect who ended up the winner by a wide margin,” López Obrador said Monday. “She is going to be Mexico’s first (woman) president in 200 years.”

The main opposition candidate, Gálvez, a tech entrepreneur and former senator, had promised to take a more aggressive approach toward organized crime.

In her concession speech, she said, “I want to stress that my recognition (of Sheinbaum’s victory) comes with a firm demand for results and solutions to the country’s serious problems.”

Julio García, a Mexico City office worker, had told the AP he was voting for the opposition in Mexico City’s central San Rafael neighborhood.

“They’ve robbed me twice at gunpoint. You have to change direction, change leadership,” the 34-year-old was quoted as saying. “Continuing the same way, we’re going to become Venezuela.”

Disregard the partisan & outrageous order from the Electoral Commission – Omane Boamah orders NDC agents

The Director in charge of Elections and IT of the National Democratic Congress has condemned Anither attempt by the Electoeal Commission to manipulate the electoral register by denying party agents access to witness the ongoing exercise

It has since ordered NDC agents tk disregard a directive by the EC to its officers do block party agents under the guise of preventing clashes

NO gerrymandering!*

The Deputy Chairman Operations of the Electoral Commission (EC) must return the bribe he has taken from the ruling NPP if he has been induced to aid gerrymandering.

What does the EC and the NPP have to hide such that they do not want Agents of political parties to observe the ongoing voter transfer exercise?

Will they stop any legitimate Civil Society Organisation from observing the voter transfer process?

What does the EC have to hide?

We are living in a very volatile electoral environment where the EC has proven to be incompetent at working basic arithmetic to collate the 2020 presidential election results.

Furthermore, in recent times, the EC has proven beyond reasonable doubt that the use of simple Excel to collate the total number of registered voters is more complex than quantum mechanics.

How does the EC expect the NDC and any reasonable Ghanaian to trust that they will be up to the task without checks and balances?

Additionally, how does the EC expect a Returning Officer alone to ascertain the authenticity of the mandatory 12 months or more stay of a voter seeking to transfer his/her vote in our very informal dominant society?

The EC by this directive to stop Agents of political parties from observing the ongoing voter Transfer exercise has once again proven to the NDC that they’re not interested in free, fair, and transparent elections.

As a result, we are directing our agents and regional and constituency executives to disregard this partisan order from the Deputy Chairman Operations of the Electoral Commission.

As agreed at the IPAC meeting (held last week on Wednesday 29th May, 2024 in the presence of Mrs. Jean Adukwei Mensah, the Chairperson of the Electoral Commission of Ghana), NDC agents must appear at the EC offices tomorrow to safeguard the sanctity of the upcoming elections and the peace of our dear country.

*No gerrymandering!*

Besides, there is no aspect of our electoral laws that explicitly stops agents from observing voter transfer!

Therefore, we shall not allow a few partisanly biased people working at the EC to destroy our cherished democracy!

Ato Foson files injunction against ongoing Ambulance case

Lawyers for Hon. Ato Forson have filed a supplementary affidavit in support of the motion on notice for an order of mistrial, injunction and/or stay of proceedings in the ongoing ambulance case.

The trending *recording* of a telephone conversation between Mr. Jakpa and the dishonorable Attorney-General Godfred Dame, that contains evidence of criminal and prosecutorial misconduct on the part of the AG, has been annexed to the affidavit.

Also, certain quotations contained in some media reports, particularly by *Asaase Radio* that border on professional misconduct on the part of the AG, have been cited and annexed to the process.

Based on the impugned conduct of the AG which stands uncontested, *Hon. Ato Forson is requesting the honorable court to declare a mistrial in the interest of justice,* which must not only be done but be manifestly seen to be done.

The minority leader avers that the Attorney General has embarked on reprehensible and unlawful conduct, conduct unbecoming of an Attorney-General, let alone the Minister for justice, for the sole purpose of securing his conviction.

And that, if the Court were to ignore these rather grave matters to proceed with the trial regardless, that would amount to a real travesty of justice, as the Court would have disregarded credible and cogent claims of misconduct by the Attorney General.

He argues that if a mistrial is not ordered and such blatant disregard for the rule of law and the ethics of prosecution by no mean a person than the Attorney-General and Minister for Justice is glossed over and allowed to pass without any consequences, public confidence in the administration of justice will be adversely affected.

The application is likely to be moved on Tuesday, 4th June, 2024.

New road projects under my next government shall include special lanes for motor riders – Mahama

The 2024 Flagbearer of the National Democratic Congress, John Dramani Mahama says all new road projects, especially those in capital cities shall make provision for special lanes for motor cyclists. The policy, according to him will guarantee extra safety for road users and enhance the Okada business which has come to stay.

The former President, said the move is necessary to incorporate their contribution to national development.

 

“The roads we constructed in Tamale for example has dedicated lanes for motor users. So if we are constructing new roads, we will make available special lanes for such users” Mr Mahama explained during a meeting with the members of the Okada Riders Association at Ashaiman on Friday, May 31, 2024.

John Mahama who has reiterated his promise to regularise commercial motorcycle business also promised to introduce electric motorbikes.
“There are electric motorbikes which run on electricity. Once you charge it at night, you are good to go. It consumes less electricity and it is better than using fuel. We will introduce them if we come to power.” he emphasized.

“Drivers must also know that motor cyclists are also road users. When a motorcycle is ahead of you on the road, consider it to be a car and drive with that in mind” he advised.

It was full of excitement, pomp and pageantry when John Mahama met with the Okada Riders. The riders drawn from across the capital and parts of the central and Easter region expressed confidence in John Mahama and pledged their support to ensure he wins the 2024 elections.

This is the second time the Mr Mahama is promising to legalize the activities of Okada after unsuccessful attempts at winning the 2020 election.
